We collect information in the following categories: (a) INFORMATION YOU PROVIDE: Name, email address, social media profile URLs (YouTube, Instagram, TikTok), payment information, and any communications you send us. (b) AUTOMATICALLY COLLECTED INFORMATION: IP address, browser type, device information, operating system, referring URLs, pages visited, and timestamps when you visit our website. (c) INFORMATION FROM THIRD PARTIES: Public social media data, analytics data from platforms you connect, and information from brand partners regarding collaborations. (d) AI-ASSISTED SERVICE FEATURES: We use AI technology to process your email communications and brand interactions solely for providing our core service features, such as detecting brand deal opportunities, facilitating negotiations, and managing creator communications. This AI processing is performed exclusively to deliver the services you requested — we do not use your data to train general-purpose AI or machine learning models.

2. Information We Collect

We use your information for the following purposes with the corresponding legal bases: (a) SERVICE PROVISION (Legal basis: Contract performance): To provide our creator management services, facilitate brand matching, process transactions, and communicate about your account. (b) SERVICE IMPROVEMENT (Legal basis: Legitimate interests): To analyze usage patterns, enhance user experience, and develop new features to better serve you. (c) MARKETING (Legal basis: Consent): To send promotional communications about our services. You may opt out at any time. (d) LEGAL COMPLIANCE (Legal basis: Legal obligation): To comply with applicable laws, regulations, and legal processes. (e) AUTOMATED DECISION-MAKING: We use AI to assist with brand matching recommendations and pricing suggestions. You have the right to request human review of any automated decision that significantly affects you.

3. How We Use Your Information

WE DO NOT SELL YOUR PERSONAL INFORMATION. We may share your data with: (a) SERVICE PROVIDERS: Third parties who assist our operations under data processing agreements, including: Railway (cloud infrastructure, Singapore), Stripe (payment processing, USA), PostHog (analytics, EU). All service providers are bound by Data Processing Agreements (DPAs) requiring them to protect your information. (b) BRAND PARTNERS: Limited profile information necessary for brand matching, only with your consent. (c) LEGAL REQUIREMENTS: When required by law, court order, or government request. (d) BUSINESS TRANSFERS: In connection with a merger, acquisition, or sale of assets, with notice to you.

4. Information Sharing

We implement industry-standard security measures to protect your personal information, including: encryption in transit (TLS 1.3) and at rest (AES-256), access controls and authentication, regular security assessments, and employee training. However, no method of transmission over the internet is 100% secure. In the event of a data breach affecting your personal information, we will notify you and relevant authorities within 72 hours as required by law.

5. Data Security

We retain your personal information for the following periods: (a) ACCOUNT DATA: For the duration of your account plus 3 years after account closure. (b) TRANSACTION RECORDS: 7 years after the transaction date (legal requirement for tax and accounting purposes). (c) COMMUNICATION RECORDS: 3 years after the communication. (d) TECHNICAL LOGS: 12 months. (e) AI-PROCESSED DATA: Data processed by AI for service provision follows the same retention periods as its corresponding data category above. We do not maintain separate copies of data for AI model training purposes. DELETION PROCESS: Upon account deletion request, we will delete your active data within 30 days and backup data within 90 days, except where retention is required by law.

6. Data Retention

Under applicable data protection laws, you have the following rights: (a) RIGHT OF ACCESS: Request a copy of your personal data. (b) RIGHT TO RECTIFICATION: Request correction of inaccurate data. (c) RIGHT TO ERASURE: Request deletion of your data ("right to be forgotten"). (d) RIGHT TO RESTRICT PROCESSING: Request limitation of how we use your data. (e) RIGHT TO DATA PORTABILITY: Receive your data in a machine-readable format. (f) RIGHT TO OBJECT: Object to processing based on legitimate interests or for direct marketing. We use cookies and similar technologies to enhance your experience and analyze usage patterns. TYPES OF COOKIES: (a) Essential cookies: Required for service operation. (b) Analytics cookies: Help us understand how you use our services (PostHog). (c) Preference cookies: Remember your settings and preferences. You can control cookie settings through your browser. We use PostHog for analytics to understand how users interact with our services.

8. Cookies and Tracking

Kinni is operated from Seoul, Republic of Korea. Your personal information may be transferred to and processed in countries outside your residence, including Singapore (Railway cloud infrastructure) and the United States (Stripe payment processing). TRANSFER MECHANISMS: We use Standard Contractual Clauses (SCCs) approved by the European Commission for transfers to countries without adequate data protection. SAFEGUARDS: All international transfers are protected by encryption, access controls, and contractual obligations. We can provide a copy of our Data Processing Agreements upon request.

9. International Data Transfers

Our services are not intended for individuals under 18 years of age. We do not knowingly collect personal information from children. If you believe we have collected such information, please contact us immediately, and we will delete it promptly.

10. Children's Privacy

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA): (a) Right to know what personal information we collect and how it is used. (b) Right to delete your personal information. (c) Right to opt out of the sale of personal information (we do not sell personal information). 11. California Privacy Rights

We may update this Privacy Policy from time to time. We will notify you of significant changes at least 30 days before they take effect by posting a notice on our website or sending you an email. Your continued use of our services after changes constitutes acceptance.

12. Changes to This Policy

GOOGLE API SERVICES USER DATA POLICY COMPLIANCE: Kinni's use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy (https://developers.google.com/terms/api-services-user-data-policy), including the Limited Use requirements. YOUTUBE DATA ACCESS: When you connect your YouTube channel to Kinni, we access the following data through YouTube API Services: (a) Channel information (name, subscriber count), (b) Video metadata (titles, descriptions, publish dates), (c) Analytics data (views, watch time, audience demographics), (d) Revenue data (if you are a YouTube Partner Program member and provide consent). YOUTUBE OAUTH SCOPES: Kinni requests the following OAuth scopes: (a) youtube.readonly - to access your channel and video information for analytics, (b) yt-analytics.readonly - to retrieve viewing statistics and audience insights, (c) yt-analytics-monetary.readonly - to access revenue data for YouTube Partner Program members. GOOGLE CALENDAR DATA ACCESS: When you connect your Google Calendar to Kinni, we access the following data through Google Calendar API: (a) Calendar event details (titles, dates, times), (b) Calendar metadata for synchronization. Google Calendar is used solely to help you track scheduled content, deadlines, and brand collaboration timelines within the Kinni dashboard. GMAIL DATA ACCESS: When authorized by your organization's administrator through Google Workspace domain-wide delegation, Kinni accesses the following Gmail data: (a) Email messages related to brand deal inquiries and collaborations, (b) Email metadata (sender, recipient, subject, date). Gmail scopes used: (a) gmail.readonly - to read incoming brand deal emails, (b) gmail.send - to send responses on your behalf, (c) gmail.compose - to draft communications with brand partners. Gmail data is used solely to detect brand deal opportunities, facilitate negotiations, and manage creator-brand communications as part of our core service. PURPOSE OF USE — ALL GOOGLE DATA: We use Google user data solely to provide and improve our application's user-facing features. Specifically: (a) Provide analytics dashboards and performance insights, (b) Detect and manage brand deal opportunities from email communications, (c) Synchronize calendar events for content scheduling, (d) Generate personalized content recommendations specific to your account. AI AND MACHINE LEARNING: We use third-party AI services (Anthropic Claude as primary provider, Google Gemini as secondary provider) to process Google user data solely for providing our app's core functionality — such as identifying brand deals in emails and generating channel insights. Your Google user data is NOT used to: (a) Train general-purpose AI or machine learning models, (b) Build user profiles for purposes unrelated to providing our services, (c) Improve AI models outside of providing your specific service features. LIMITED USE REQUIREMENTS: In accordance with Google's Limited Use requirements: (a) We only use Google user data to provide or improve user-facing features that are prominent in our application's user interface, (b) We do not transfer Google user data to third parties unless necessary to provide or improve user-facing features, as required by law, or with explicit user consent, (c) We do not use Google user data for serving advertisements, (d) We do not allow humans to read Google user data unless we have your affirmative agreement, it is necessary for security purposes, to comply with applicable law, or the data is aggregated and anonymized for internal operations. REVOKING ACCESS: You may revoke Kinni's access to your Google account at any time by visiting https://myaccount.google.com/permissions and removing Kinni from the list of connected apps. For Gmail access granted through Workspace domain-wide delegation, contact your organization's administrator. DATA RETENTION: Google user data (YouTube, Calendar, Gmail) is retained only as long as your account is connected and active. Upon disconnection or account deletion, all Google-specific data is deleted within 30 days. We do not retain Google user data for AI model training purposes. 13. Google API Services User Data

INSTAGRAM DATA ACCESS: When you connect your Instagram Business or Creator account to Kinni, we access the following data through the Instagram API: (a) Profile information (id, username, name, profile_picture_url, followers_count, follows_count, media_count, biography, website, account_type), (b) Media metadata (posts, reels, stories), (c) Engagement metrics (reach, impressions, likes, comments, saves), (d) Audience demographics, (e) Direct messages (only with separate consent for DM automation features). OAUTH SCOPES: Kinni requests the following OAuth scopes to provide our services: (a) instagram_business_basic - to access your profile information and media for analytics, (b) instagram_business_manage_insights - to retrieve engagement metrics and audience demographics, (c) instagram_business_manage_comments - to analyze comment sentiment and engagement patterns, (d) instagram_business_manage_messages - to enable DM automation features (requires separate consent). OPTIONAL DM ACCESS: Direct message access (instagram_business_manage_messages) is an optional feature that requires explicit, separate consent. If enabled, we process only the first 200 characters of messages for classification purposes. PURPOSE OF USE: We use this data solely to: (a) Provide analytics dashboards and performance insights, (b) Generate AI-powered content recommendations specific to your account, (c) Track brand collaboration performance, (d) Enable DM automation for brand inquiries (if consented). AI AND MACHINE LEARNING: Your Instagram data is NOT used to train general-purpose AI or machine learning models. We only use your data to provide personalized recommendations and insights specific to your account. DATA RETENTION: Instagram data is retained only as long as your account is connected. DM logs are retained for 90 days for service improvement purposes. Upon disconnection or account deletion, all Instagram-specific data is deleted within 30 days. DATA DELETION PROCESS: You can request deletion of your Instagram data at any time by: (a) Disconnecting your Instagram account in Kinni settings, (b) Contacting us at june@kinni.ai, (c) Using Meta's data deletion callback (we automatically process Meta's deauthorization and data deletion requests within 30 days). DATA SECURITY: All Instagram data is encrypted using AES-256 at rest. We verify Meta webhook signatures using HMAC-SHA256 to ensure data integrity. WE DO NOT: (a) Sell your Instagram data, (b) Use your Instagram data for advertising purposes, (c) Share your Instagram data with third parties except essential service providers bound by data protection agreements. REVOKING ACCESS: You may revoke Kinni's access to your Instagram account at any time by: (a) Disconnecting in Kinni settings, (b) Removing Kinni from Facebook Settings > Business Integrations, (c) Removing Kinni from Instagram Settings > Apps and Websites. 14. Instagram API Services User Data

TIKTOK DATA ACCESS: When you connect your TikTok account to Kinni, we access the following data through TikTok API Services: (a) Basic profile information (open_id, display name, avatar URL), (b) Profile details (username, bio description), (c) Account statistics (follower count, following count, video count, likes count), (d) Video list and performance metrics (views, likes, comments, shares). OAUTH SCOPES: Kinni requests the following OAuth scopes to provide our services: (a) user.info.basic - to display your profile and identify your account, (b) user.info.profile - to show your username and bio, (c) user.info.stats - to track follower growth and generate performance reports, (d) video.list - to analyze content performance and provide AI recommendations. PURPOSE OF USE: We use this data solely to: (a) Provide analytics dashboards showing your TikTok performance, (b) Track follower growth and engagement trends over time, (c) Generate AI-powered content strategy recommendations, (d) Identify top-performing videos and content patterns. AI AND MACHINE LEARNING: Your TikTok data is NOT used to train general-purpose AI models. We only use your data to provide personalized insights specific to your account. TIKTOK DEVELOPER TERMS COMPLIANCE: Kinni's use of TikTok Developer Services adheres to the TikTok Developer Terms of Service. Specifically: (a) We do not sell your TikTok data, (b) We do not use your TikTok data for advertising purposes, (c) We do not share your TikTok data with third parties except essential service providers, (d) All access tokens are encrypted with AES-256 before storage. REVOKING ACCESS: You may disconnect your TikTok account at any time through your Kinni account settings. You can also revoke access directly from TikTok's app settings under "Manage app permissions." DATA RETENTION: TikTok data is retained only while your account is connected. Upon disconnection or account deletion, all TikTok-specific data (videos, metrics, analytics) is deleted within 24 hours. Access tokens are cleared immediately upon disconnection. DATA DELETION REQUESTS: We support TikTok's authorization.removed webhook to automatically process disconnection requests. When you revoke access from TikTok, your data is automatically marked for deletion. DATA SECURITY: All TikTok data is encrypted using AES-256 at rest. We verify TikTok webhook signatures to ensure data integrity. 1. Acceptance of Terms

Kinni provides AI-powered business management services for content creators, including brand matching, negotiation support, contract review, payment collection, and analytics across YouTube, Instagram, and TikTok platforms. Our services utilize artificial intelligence and machine learning technologies to assist with routine tasks, while our expert team handles critical negotiations and decisions. IMPORTANT DISCLAIMERS: (a) Kinni is NOT a traditional talent manager, agent, or entertainment attorney. We do not provide legal, tax, or financial advice. (b) We do not guarantee any specific income, deal volume, or business results. (c) Our AI-generated suggestions and analyses are provided for informational purposes only and should not be relied upon as professional advice. You are solely responsible for your business decisions.

2. Description of Service

In compliance with applicable AI regulations including the EU AI Act, we provide the following disclosures about our AI systems: (a) AI USAGE: We use AI technologies for email analysis, brand matching recommendations, contract clause identification, pricing suggestions, and automated communications. (b) HUMAN OVERSIGHT: All AI-generated recommendations for significant decisions (contract terms, pricing, brand partnerships) are reviewed by human experts before final implementation. You retain final approval authority over all decisions. (c) LIMITATIONS: AI systems may produce inaccurate results, miss important context, or make errors. AI recommendations should be verified before acting upon them. (d) DATA USAGE: By using our services, you consent to our use of anonymized interaction data to improve our AI models. You may opt out of AI model training by contacting us at june@kinni.ai. (e) AUTOMATED DECISIONS: You have the right to request human review of any automated decision that significantly affects you.

3. AI Services Transparency

You must be at least 18 years old and capable of forming a binding contract to use our services. By using Kinni, you represent that you meet these requirements and that all information you provide is accurate and complete.

4. Eligibility

You are responsible for providing accurate information during registration and maintaining the security of your account credentials. You must promptly notify us of any unauthorized access to your account. You are responsible for all activities that occur under your account.

5. Account Registration

COMMISSION RATE: Kinni charges a commission of 10% on all Gross Revenue from brand collaborations facilitated through our service. GROSS REVENUE DEFINITION: "Gross Revenue" includes all compensation received in connection with brand collaborations, including but not limited to: (a) cash payments, (b) fair market value of products, services, or other non-cash compensation, (c) bonuses, performance incentives, and backend payments, (d) licensing fees, usage rights fees, and royalties, (e) any payments for exclusivity periods or non-compete agreements. TAIL PERIOD: If you terminate this agreement or cease using Kinni's services, you remain obligated to pay the applicable commission on any Gross Revenue received from brands that were introduced to you through Kinni for a period of 12 months following termination ("Tail Period"). This applies to any deals closed with such brands during the Tail Period, regardless of whether Kinni was involved in negotiating such deals. PAYMENT TERMS: Commissions are due within 7 business days of your receipt of payment from brands. You agree to provide accurate payment information and promptly report all brand payments. NO HIDDEN FEES: There are no monthly fees, setup costs, or cancellation penalties beyond the commission structure described above.

6. Commission, Fees, and Payment

You agree to provide accurate information about your social media channels, respond promptly to time-sensitive opportunities, maintain ownership and rights to your content, and comply with all applicable laws and platform terms of service.

7. User Responsibilities

You may not: (a) provide false or misleading information, (b) use our services for illegal purposes, (c) attempt to circumvent our commission structure, including but not limited to negotiating directly with brands introduced through Kinni without paying applicable commissions, (d) interfere with our systems or other users, or (e) violate any third-party rights.

8. Prohibited Activities

Kinni and its licensors retain all rights to our platform, technology, and branding. You retain all rights to your content. By using our services, you grant us a limited license to use your public profile information for matching you with brands.

9. Intellectual Property

Unlike traditional management agencies, Kinni does not require exclusive contracts. You are free to work with other management services or handle deals independently. You may terminate your use of Kinni at any time, subject to completing active collaborations and the Tail Period provisions in Section 6.

10. No Exclusive Contract

We may modify, suspend, or discontinue any part of our services at any time. We will provide reasonable notice of significant changes. Your continued use after changes constitutes acceptance of the modified terms.

11. Service Modifications

TERMINATION BY YOU: You may terminate this agreement at any time by providing written notice to june@kinni.ai. TERMINATION BY KINNI: We may terminate or suspend your account immediately, without prior notice, if: (a) you breach any provision of these terms, (b) you engage in fraudulent activity, (c) you fail to pay commissions when due, (d) you attempt to circumvent our commission structure, or (e) we are required to do so by law. EFFECTS OF TERMINATION: Upon termination: (a) you remain responsible for all commissions owed, including during the Tail Period, (b) your access to our platform will be revoked, (c) we will provide reasonable assistance transitioning active collaborations. SURVIVAL: Sections 6 (Commission), 12 (Termination), 13 (Disclaimers), 14 (Limitation of Liability), 15 (Indemnification), and 16 (Dispute Resolution) survive termination.

12. Termination

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM: (a) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (b) ANY WARRANTY THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (c) ANY WARRANTY REGARDING THE ACCURACY OF AI-GENERATED CONTENT OR RECOMMENDATIONS. WE DO NOT GUARANTEE: specific results, deal volumes, earnings, or income levels. WE ARE NOT RESPONSIBLE FOR: (a) brand behavior, payment delays from brands, or content performance, (b) accuracy of AI-generated suggestions or analyses, (c) actions or omissions of third parties, including brands and platforms, (d) any loss resulting from your reliance on AI recommendations without independent verification.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) KINNI'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (i) THE AMOUNT OF COMMISSIONS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (ii) ONE HUNDRED US DOLLARS ($100). (b) IN NO EVENT SHALL KINNI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER KINNI WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. (c) THE LIMITATIONS IN THIS SECTION REFLECT THE ALLOCATION OF RISK BETWEEN THE PARTIES AND ARE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN US. OUR SERVICES WOULD NOT BE PROVIDED WITHOUT THESE LIMITATIONS.

14. Limitation of Liability

YOUR INDEMNIFICATION OF KINNI: You agree to indemnify, defend, and hold harmless Kinni and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your content, (b) your breach of these terms, (c) your violation of any third-party rights, or (d) your use of our services. KINNI'S INDEMNIFICATION OF YOU: Kinni agrees to indemnify, defend, and hold harmless you from claims arising directly from Kinni's gross negligence or willful misconduct in providing the services, provided that you promptly notify us of any such claim and cooperate in its defense.

15. Indemnification

INFORMAL RESOLUTION: Before initiating any formal dispute resolution, you agree to first contact us at june@kinni.ai and attempt to resolve the dispute informally for at least 30 days. BINDING ARBITRATION: If the dispute cannot be resolved informally, you and Kinni agree to resolve any disputes through binding arbitration administered by the Korean Commercial Arbitration Board (KCAB) in Seoul, Korea, in accordance with its rules. The arbitration shall be conducted in Korean or English, at the claimant's choice. The arbitrator's decision shall be final and binding. CLASS ACTION WAIVER: YOU AND KINNI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. OPT-OUT: You may opt out of the arbitration and class action waiver provisions by sending written notice to june@kinni.ai within 30 days of first accepting these terms. GOVERNING LAW: These terms are governed by the laws of the Republic of Korea, without regard to conflict of law principles.

16. Dispute Resolution

Neither party shall be liable for any failure or delay in performing their obligations under these terms due to circumstances beyond their reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials. If a force majeure event continues for more than 60 days, either party may terminate this agreement without liability.

17. Force Majeure

If any provision is found unenforceable, the remaining provisions continue in effect. Our failure to enforce any right does not waive that right. These terms constitute the entire agreement between you and Kinni, superseding all prior agreements. You may not assign these terms without our consent; we may assign them freely.

18. General Provisions

We may update these terms from time to time. We will notify you of material changes at least 30 days before they take effect via email or website notice. Your continued use of our services after changes constitutes acceptance. If you disagree with any changes, you must stop using our services.
